WHY OWNERS NEED TO SIGN AUTHORITY TO SELL
Sometimes
we get requests from property owners to sell their properties but will not issue an Authority to Sell. Why do we need an Authority
to Sell from you? A written Authority to Sell issued by property owners to a selling broker will verify and confirm
that the party requesting to sell property is the rightful owner or has the authority to request sale for subject real
estate. Among other things, we also have to protect our buyers. This will also confirm that the owner agrees to the
terms and conditions of the Authority and will prevent disputes later on.
The
one signing Authority must be the one whose name is on the property title, or his appointed Attorney-In-Fact.
It
is much easier and simplier to sell properties with Authority to Sell because we can easily network through our MLS or Multiple
Listing System wherein it is a requirement.

AUTHORITY TO SELL
This is to authorize EVERRA REAL ESTATE CORPORATION to do and perform any and
all of the following acts:
That EVERRA REAL ESTATE
CORPORATION shall receive a commission fee equivalent to FIVE ( 5% ) PERCENT
of
Agreed Selling Price payable upon the execution of the Deed of Absolute
Sale.
Real Estate Tax, Capital Gains
Tax, and any unpaid utility bills will be for the account of the Seller.
Registration Fee, Notarial Fee,
Transfer Tax, Documentary Stamps and other expenses to be incurred in the
process of transferring Title will be in
the account of the Buyer.
This
Non-Exclusive authority shall become ineffective only after 30 days from
receipt of either party of a written notice terminating such authority.
Notwithstanding
the expiration of this Authority, EVERRA REAL ESTATE CORPORATION
shall be
entitled to commission in case its prospective client whom the same have
previously registered with us purchases the property. It is also understood that
all negotiations
with EVERRA’s registered prospective clients shall be coursed through the same. For any Earnest Money/ Option Money from the Buyer
for cancelled transactions, EVERRA Real Estate Corp. is entitled to 50% but not more than the FIVE percent (5%) commission.
Moreover,
this will also authorize EVERRA REAL ESTATE CORPORATION to post
details of the unit in its EVERRA
REAL ESTATE CORPORATION
websites and in other forms of media.
